Trackama - PRIVACY POLICY
This Privacy Policy governs the manner in which Trackama collects, uses, maintains and discloses information collected from users (each, a "User") of the www.Trackama.com website ("Site") and the downloadable version on wireless device (“App”). This privacy policy applies to the Site, App and all products and services offered by Trackama. The Services are not intended for use by persons under the age of 16. If you are under 16, you may not download the App or use the Site. Trackama has the discretion to update this privacy policy at any time.
Information That We Collect
We may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our Site, download the App, register on the Site, fill out a form, and in connection with other activities, services, features or resources we make available on our Site and mobile App. Users may be asked for, as appropriate, name, permission to use location services, Users contact, email address, phone number.
You can decide whether or not to upload content - such as road incidents, traffic gridlock etc - to the Services. However any content that you submit for posting, may be viewed by all users of Trackama but will not reveal any of your personal identifications except your system generated username or your own chosen username. Therefore you are strongly advised not to use any of your real personal identifications such as names as your username. In any event your email address will not be visible to others through any reports or User posts that you share or upload.
We, at Trackama, take great measures to provide you with the best experience you can have while using the Service. However, Trackama has no control over the conduct of any User and disclaims all liability in this regard. Users are advised to carefully and thoroughly consider whether or not to make available any information and carefully examine all necessary details related to any communication with other users prior to any engagement or communication being made. Participating in any User's activities as a result, directly or indirectly, from using Trackama, is entirely at your own risk. Trackama is not a party to any agreement entered into between the users in any circumstances. The User has the sole and ultimate responsibility regarding compliance with all laws, regulation or any other duty. We do not accept any liability for any loss, damage, cost or expense that you may suffer or incur as a result of or in connection with your participation in any activity or event initiated, held or conducted by a User or a third party nor in connection to any agreement between the users or third parties, including any activity or event related in any way, directly or indirectly
Signing onto Trackama by using your social network account (such as your Facebook account), you agree to share information (including personal information) between Trackama and such social networks, for the purposes provided under this Privacy Policy.
The social network's use of information made available by Trackama is governed by that social network's privacy policy and controlled by the social network, not by this Privacy Policy or Trackama. When you connect to the social network account through the Services for the first time or otherwise make the Services interact with your social network account, you will be asked to permit the social network to share your personal information stored on such social network with the Services. We collect your information from your social network account only in accordance with your privacy settings you have set up under your social network accounts.
Trackama allows you to use the Services whether or not you choose to specifically set up a username for yourself. The service cannot be used without a username, therefore during installation of the application on mobile device, the application automatically generates a username for you which you can change during the installation or at anytime you wish by going to the settings of the application to do so. Note that it is not mandatory to use the system generated username but be informed that whatever username associated to your account will be available to the other users of the service without exposing other personal information we might have collected in accordance to this policy. The provision of a username by you is mandatory on the website.
The categories of information collected by Trackama will include all or just some of the following, depending on how you choose to use the Services. Whenever you use the Services, Trackama will collect:-
- Detailed location and route information, for example in the form of GPS codes and other information sent by your mobile device on which the App is installed and activated. Trackama uses this location and route information to create a detailed and aggregated traffic information on the routes you have travelled while the device is on.
- Periodically, all of the phone numbers which are stored on your phone contacts book. This information will be used as part of the ‘invite users’ feature to help find and create a list of other Trackama users who you may know and with whom you may wish to share information addresses, directions, invitation etc.
- Your phone number. Your phone number will be used to enhance sharing, invitation, direction services with other users of Trackama based on your preference.
- Bear in mind that false, incorrect, or out-dated information may impair Trackama's ability to provide you with the Services and to contact you when necessary. Trackama will explicitly indicate the fields for mandatory completion. If you do not enter the requisite data in these fields, you may not be able to set up a username.
- Information shared from your social network accounts. This only occurs when you have decided to login into Trackama with your social network account which aids your registration for the Service.
Please note that when you first install the App on your mobile device, Trackama will set up an account associated with that mobile device (the “Account” ). Trackama will collect and use your information, in accordance with this Privacy Policy, whenever you activate the App on that mobile device. This use includes linking your information with your Account.
Trackama will link all of your information with your Account and the username. This includes information received from all mobile devices running the App on which you have chosen to sign in using your username; information associated with your Account will be visible only to Trackama; and when the App is on, your approximate location and other information you may choose to contribute will be visible anonymously to other users except you have decided to use your real name or any of your real personal identity as your username.
Your log in details are your responsibility. You are fully accountable for any use or misuse of your Account and personal details as a result of conveying your details – most especially your username - to someone else. You must maintain your log in details in absolute confidentiality and avoid disclosing them to others. Make sure that you change your password and username frequently and at least once every six months.
Non-Personal Identification Information
We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer or mobile device and technical information about Users means of connection to our Site, such as the operating system and the Internet service providers utilized and other similar information.
How We Use Collected Information
Trackama may collect and use Users personal information for the following purposes:
To analyze traffic condition
Information you provide in form of GPS signals are used to analyze and serve traffic situations to other Users of the Service. Trackama may also use anonymous, statistical or aggregated information collected on the Services, in a form that does not enable the identification of a specific User, by posting, disseminating, transmitting or otherwise communicating or making available such information to users of the Services, to the Services' providers, partners and any other third party. For example, GPS information that we receive from your mobile device may be provided to relevant transport authorities as part of an aggregated data in an anonymous form to help improve the road conditions and solve traffic problems.
To personalize User experience
We may use information in the aggregate to provide enhanced location services to the Users and also to understand how our Users as a group use the services and resources provided on our Site. Trackama may use your location and route information to provide navigation services and to provide information about relevant places of interest in your close vicinity; and use your phone number and the phone numbers which are stored in your device’s phone book to find and create a list of other Trackama users whom you may know and with whom you may wish to share information addresses, directions, invitation e.t.c
To improve our Service
Trackama may use anonymous, statistical or aggregated information (including anonymous location information), in a form that does not enable the identification of a specific User, to properly operate the Services, to improve the quality of the Services, to enhance your experience, to create new services and features, including customized services, to change or cancel existing content or service, and for further internal, commercial and statistical purposes.
We may also use feedback you provide to improve our Service.
To process payments
We may use the information Users provide about themselves when subscribing for access to the Service on the Site for identification and reconciliation purposes. We do not share this information with outside parties except to the extent necessary to provide the Service as well as to the extent not beyond those mentioned in the “Sharing your personal information” section.
To send periodic emails
We may use the email address to respond to their inquiries, questions, and/or other requests.
How we protect your information
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, subscription information, addresses, location information and data stored on our database. However, these measures are unable to provide absolute assurance. Therefore, although Trackama takes great efforts to protect your personal information, Trackama cannot guarantee and you cannot reasonably expect that Trackama's databases will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse.
Sharing Your Personal Information
We do not sell, trade, or rent Users personal identification information to others except in under the following conditions:
- If Trackama reasonably believes that you have breached the Terms of Use, or abused your rights to use the Services, or performed any act or omission that Trackama reasonably believes to be violating any applicable law, rules, or regulations. Trackama may share your information in these cases, with law enforcement agencies and other competent authorities and with any third party as may be required to handle any result of your wrongdoing;
- If Trackama is required, or reasonably believes that it is required by law to share or disclose your information;
- In any case of dispute, or legal proceeding of any kind between you and Trackama, or between you and other users with respect to, or in relation with the Services;
- In any case where Trackama reasonably believes that sharing information is necessary to prevent imminent physical damage or damage to property;
- If Trackama organizes the operation of the Services within a different framework, or through another legal structure or entity, or if Trackama is acquired by, or merged into or with another entity, or if Trackama enters bankruptcy, provided however, that those entities agree to be bound by the provisions of this Privacy Policy, with respective changes taken into consideration;
Trackama may also share personal information with companies or organizations connected or affiliated with Trackama, such as subsidiaries, sister-companies and parent companies. Personal information may also be shared with Trackama's other partners and service providers, with the express provision that their use of such information must comply with this Privacy Policy.
Advertising
Ads appearing on our Trackama are delivered to Users using the User location information. This information, among other things, assist us to deliver targeted advertisements that we believe will be of most interest to you. When you visit a third party website from the Application, such third party may use cookies on your computer. The third party’s use of cookies is subject to their own privacy policies and not to this Privacy Policy. If you wish to study the privacy policies of those third parties you should visit their services, or contact them directly.
Changes To This Privacy Policy
Trackama has the discretion to update this privacy policy at any time. When we do, we will post a notification on the main page of our website, revise the updated date at the bottom of the page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.
Your Acceptance Of These Terms
By using this Site or the downloadable App, you signify your acceptance of this policy. If you do not agree to this policy, please do not use our Site or App. Your continued use of the Site or App following the posting of changes to this policy will be deemed your acceptance of those changes.
